• Trademarks Malaysia is part of the Trademark Planet group. It was built by IP lawyers who have a wealth of experience in intellectual property, including trademarks, patents, branding and copyright.

With decades of local and international experience in the IP world, we know the challenges of the trademark registration process inside-out. We built Trademarks Malaysia to remove the common pitfalls and to make the process to apply to register a trademark as smooth as possible.

Once you have determined the trademark you'd like to protect in Malaysia, Trademarks Malaysia is the ideal place to do this. Our easy-to-use online application service makes the Malaysia trademark application process hassle-free.

  • A trademark registration gives you the exclusive right to use that trademark for the specific products and services you’ve registered it for.

It protects you from a competitor mimicking your products and passing them off as theirs and causing confusion or harm to your business reputation.

When you establish a new business, trademark protection might not be top of mind, but as your business grows and succeeds, your brand can become a very valuable asset, which you need to protect.

A registered trademark gives you legal grounds to take action to stop someone else using the same or a confusingly similar mark. Protecting your brand names and logos will help you set your brand or business apart from competitors and protect you from copycats!

A trademark registration will give you peace of mind. It also sends a powerful message to your customers that you believe that your brand is worth protecting. It's an investment worth making, before it's too late.

  • The cost depends on how many trademarks you want to protect and how many categories of products/services you need.

The total cost for an application covering one category/class is MYR 2500. If you want to add extra classes, each extra class included costs MYR 1500.

Our costs include all Trademark Office official fees.

  • Completing the trademark application form online only takes a matter of minutes. The application will then be passed on to our trusted local partner, and submitted to the Malaysia Trademark Office.

The Malaysia trademark application process, from submission through to registration, takes around 12 months. Timeframes can vary, depending on whether the Trademark Office raises any issues that need to be addressed.

  • Trademark applications are submitted to the Trademark Office as soon as our trusted local partner has confirmed all the required information to submit a valid application, within 1-2 business days.

If you change your mind and cancel your order before the trademark application has been submitted to the Trademark Office, we will refund you the fees paid minus MYR 250 to cover non-refundable payment gateway and validation/administrative costs.

Once your trademark application has been submitted to the Trademark Office, it is not possible to get a refund because the official Trademark Office fees have been paid.

  • The Trademark Office does not permit changes to the trademark where those changes affect the identity of the trademark. This is interpreted quite narrowly so the addition or removal of any significant words or extra material means that they will not allow the trademark to be changed or updated.

The Trademark Office does not allow classes to be added to an application after it has been submitted, but you can submit another application for additional classes at any time.

It is sometimes possible to correct an error soon after the application has been submitted, but the approval of any change is at the discretion of the Trademark Office.

You can transfer ownership of the trademark to another entity at any time. This does incur costs.

  • You can search yourself on the Trademark Office website here: Malaysia Trademark Office.

Alternatively, you could get a trademark clearance search done via a trademark attorney. We can give you contact details of someone we trust if you'd like.

  • If you haven’t registered your trademark yet, you can identify your trademark by using the superscript TM symbol that looks like this ™.

If you have a registered trademark, you can identify it by using the superscript R symbol inside a circle: ®.

  • If you need strategic or legal advice on trademarks, please let us know and we can put you in touch with our trusted local partner.

  • This is a proceeding in which someone objects to registration of your trademark application.

After your trademark application is accepted for registration by the Trademark Office, it is published for a time period (two months) before it is registered. During this time, known as the opposition period, other entities can oppose registration by submitting an opposition with the Trademark Office.

Who can oppose a trademark application?

Any individual, company or group can submit an opposition to a trademark application. The opponent does not need to be the owner of a similar mark or have any commercial interest in the outcome.

What are grounds for a trademark opposition?

The most common grounds for opposition are that the trademark is too generic, is too similar to an earlier registered trademark and is likely to cause confusion - or that the trademark applicant is not the owner of the trademark.

While we assist with registration of trademarks, an opposition is quite a complicated proceeding with strict deadlines, and is outside the scope of services we provide. If your trademark application is opposed, we suggest talking to a specialist trademark attorney or lawyer who will be able to provide you with information on what you can do.

  • Trademarks can exist indefinitely, provided that they are continuously renewed and are being genuinely used in trade. A trademark renewal must be submitted every ten years.

If you'd like to renew your trademark, feel free to get in touch with us.

  • Each country has its own trademark register, rules and regulations. So a trademark registration in Malaysia provides protection in Malaysia only.

If you’re interested in protecting your trademark in other countries, separate trademark applications would need to be submitted in those countries.

We provide online application services in Malaysia, Singapore, New Zealand, Australia, the United Kingdom and Benelux (covering Belgium, the Netherlands and Luxembourg).

Please get in touch if you have questions about submitting applications in countries outside of Malaysia.
